(hereinafter “Definitive Development”)

Definitive Development considers the protection of your personal data important. During your contact with Definitive Development, you may share personal data with us so that we can identify you as an individual, an employee of a company, and so on (such as your full name, email address, address and telephone number). This is your “personal data”.
what personal data do we process and for what purposes?
Definitive Development collects, records and processes personal data of clients, candidates, employees, independent freelancers and other people our company is in contact with. Data is provided, for example, by people themselves when they get in touch.
Personal data is always processed in accordance with the principles of privacy legislation and the General Data Protection Regulation (European Regulation 2016/679 of 27 April 2016 on the protection of personal data). Processing is carried out in a lawful, fair and transparent manner, for specified and explicit purposes. Through regular updates of our database, Definitive Development also ensures data minimisation.
We process your personal data for, among others, the following purposes:
• Computer consultancy activities – the possible processing of company data, identification data and financial data of the persons involved.
• Retail of computers, peripherals and software in specialised stores; besides supplying software, this also covers everything from providing data centre infrastructure for companies and individuals, electrical works and custom work on a time-and-materials basis, to installing charging infrastructure – the possible processing of company data, identification data and financial data. Our consultancy activities often take place within the client’s infrastructure as a processor, as agreed with them.
• Client management – collecting prospect, contact-person and company data, identification data, financial data, and exchanging information and project information.
• Information about our professional and social activities, or any other subject that may concern you, through our communication channels (e.g. newsletter, website).
• When you contact our company via social media, or your profile is accessible within these platforms, personal data may be shared with Definitive Development as part of that platform. We advise social media users to review the privacy terms of such platforms.
• For the further performance of agreements entered into.
• Handling financial obligations.
• Data analysis to improve the efficiency and performance of our services, for which AI models may be used.
• To comply with legal obligations.
• Where the legitimate interest of the company requires it, and this is always clear to the person involved, for example for security reasons.
Other data is collected automatically through “cookies” and other systems or applications that collect information. You can find more information in our cookie pop-up.
Personal data is secured in an appropriate manner through suitable technical and organisational measures, which we prefer not to disclose. If you have any questions about this, you can contact Definitive Development.
definitive development as a processor
For the services Definitive Development provides, always on behalf of the client, Definitive Development sometimes gains access to the client’s personal data. In such situations the client acts as the “data controller” and Definitive Development as the “processor”, as described in the GDPR. In those cases you will be referred to the data controller regarding the processing of your personal data.
with whom do we share your personal data?
Definitive Development opts for partners that can guarantee the same level of protection of your personal data. Personal data will not be transferred outside the European Economic Area (EEA) unless sufficient safeguards are provided in accordance with the General Data Protection Regulation or the EU-U.S. Data Privacy Framework.
Your personal data may be shared with external business partners. These may be, for example, suppliers relating to IT infrastructure, administration or accounting obligations, but also subcontractors or sub-processors. In relation to our clients, Definitive Development usually acts as a processor; here too, professional data that may contain personal data can be shared.
how long do we keep personal data?
The retention period of personal data is limited to as long as necessary to achieve the purposes of the processing. We aim to keep an up-to-date database that is regularly updated. When you consent to direct marketing (for example a newsletter), you will always be given the option to unsubscribe.
With regard to candidates (freelancers), the following periods have been agreed:
• Candidates who are not retained: 2 years without consent, 5 years with consent.
rights of the data subject
You have various rights regarding the data we process about you. If you wish to exercise one of the following rights, please contact us or our external DPO using the contact details in the first section of this privacy statement.
Right of access and copy – You have the right to view your data and obtain a copy of it. This right also includes the possibility to request further information about the processing, including which categories of data are processed and for what purposes.
Right to correction or rectification – You have the right to have your data corrected if you believe we hold inaccurate data.
Right to erasure (right to be forgotten) – You have the right to request that we erase your data without undue delay. However, we will not always be able to grant such a request, for example when we still need the data for an ongoing file, or when keeping certain data for a specific period is legally required.
Right to restriction of processing – You have the right to restrict the processing of your data, temporarily suspending it, for example until there is certainty about its accuracy.
Right to withdraw your consent – Where processing is based on your consent, you have the right to withdraw that consent at any time by contacting us.
Right to object – You have the right to object to processing of your data based on our legitimate interests or the public interest, on grounds relating to your specific situation. In that case we must stop the processing, unless we have compelling legitimate grounds to continue. You can always object to the use of your data for direct marketing; for promotional emails you can do so easily via the “unsubscribe” button.
Right to data portability – You have the right to obtain, in electronic form, the data you provided to us yourself with your consent or in the performance of an agreement, so that it can easily be transferred to another organisation.
Right to lodge a complaint with your supervisory authority – If you believe we process your data incorrectly, you always have the right to lodge a complaint with your data protection supervisory authority, in the EEA member state where you usually reside, where you work, or where the alleged infringement took place.
